PRIVACY AND SECURITY POLICY

1. INTRODUCTION

We are GEEK Up Technology Joint Stock Company (hereinafter referred to as “GEEK Up”) have always strived to protect the personal information of customers. With the collection of more information from customers over the Internet through user registration, reward programs, user surveys, etc., the proper management and protection of Customers’ information has become more important in recent years.

Our company has established this Privacy and Security Policy (hereinafter referred to as the “Policy”) as set forth below to explain how we collect, store, use and disclose any collected data when you use GEEK Up or third party websites, platforms and applications operated by GEEK Up or its representatives ( hereinafter referred to as “Our Sites”), and how we protect the privacy and security of your information.

2. TERM OF POLICY AGREEMENT

2.1 By entering, providing, the information according to this information collection table, customers agree and confirm that the terms of this Policy (now or as changed at any time) are legally binding on Customers, and Customers are willing to comply with any provision of this Policy.

3. SUBJECTS AND SCOPE OF APPLICATION

3.1 Subjects

The subjects of this Policy are individuals and organizations (hereinafter referred to as “Customers”) that access, provide data, or use websites that collect information, other GEEK Up websites (referred to as “Our Sites”) in any form.

3.2 Scope of Application

3.2.1 The scope of this Policy includes:

  • The collection, processing, usage, storage, and protection of Customer's information when using Our Sites
  • Personal information is understood as Customers' information and all other information related to customers that collected, recorded, processed, used, stored, provided by GEEK Up during the time of their process, access and use our Sites in accordance with the law
  • Online services, facilities, tools, applications, services related to Our Websites (if any), regardless of the method Customers use to access and use them

3.2.2. This Policy does not apply to:

  • Information collected from third party websites, platforms and/or applications (“Third Party Sites”) for which GEEK Up has no control and is responsible
  • Information collected by Third Party Sites that Customers may access through links to Our Sites; or
  • Any other programs, content on Third Party Sites that we may participate in or be associated with

These Third Party Websites may have their own privacy policies, terms and conditions. We encourage you to read before using these Third Party Websites.

4. CUSTOMERS' APPROVAL

4.1 GEEK Up will not collect, use or disclose Customers' information without Customers' consent. In most cases, we will explicitly ask Customers' permission but, in some cases, we may confirm consent from Customers' actions and conduct. By using Our Sites, Customers agree to allow GEEK Up to collect, use and disclose Customers' personal information in accordance with this Policy.

4.2 We may require Customers to provide additional consent if it is necessary to use Customers' information for purposes not described in this Policy. Customers are not required to agree. If Customers decide not to agree, they may be restricted from participating in certain activities. Where Customers agree, the terms of additional consent shall prevail in the event of any conflict with the terms of this Policy.

4.3 If Customers do not consent to the collection, use and disclosure of their information in this manner, please do not use our Sites. Or Customers agree and proceed to provide information to GEEK Up to use Our Sites.

5. INFORMATION OF CUSTOMERS UNDER 18 YEARS OLD

5.1 Our Sites are created for Customers who are 18 years of age and older. In case the Customer is under 18 years old, the consent of a parent or legal guardian is required before accessing and using our websites and platforms in accordance with this Policy.

5.2 In the event that GEEK Up determines that we have collected information from Customers who are under 18 years of age without obtaining the consent of their father, mother or legal guardian, we will, as soon as possible, will proceed to stop the collection of information and delete the previously collected information (if any) without taking any liability in accordance with the law.

6. KIND OF INFORMATION ARE COLLECTED BY US

GEEK Up collects Customers' information during their interaction with Our Websites in accordance with relevant laws.

The sources of information we collect as followings:

6.1 Customers information directly provide to us

6.1.1 We collect any information Customers provide in connection with our Sites, when they:

  • Searches, interact with Our Sites
  • Register events that are organized by GEEK Up
  • Contact us through all official means such as phone call, email
  • Complete questionnaires or other informational forms
  • Other jobs as prescribed by the Policy and the law (if any)

6.1.2 Depending on Customers use of our Sites, they may provide us with information such as:

  • Personal information such as: full name, gender, date of birth, occupation
  • Information related to the Customers' identity includes: identity card information, citizen identification, passport or other identification documents with photo, social insurance number, tax code...
  • Contact information includes: home and work addresses, email addresses, phone numbers and other similar contact information
  • Information about Customers' job, work organization and their contacts, such as colleagues or people in organization
  • Customers' image, voice and other personally identifiable characteristics when attending a GEEK Up event or using Our Sites
  • Any other personal information that Customers voluntarily provide to us

6.2 Information we automatically collect when Customers use our Sites.

6.2.1 We automatically collect certain types of information when Customers interact with Our Websites (including but not limited to: email, website geekup.vn, GEEK Up Fanpage, GEEK Up LinkedIn page ...), specifically:

  • Access, interact or use Our Websites (including when Customers use a computer or other device to interact with Our Websites)
  • Download content/article from us
  • Open an email or click the link in an email from us
  • Interact or communicate with us through Our Sites

6.2.2 Depending on Customers' use of Our Sites, GEEK Up may automatically collect information, including but not limited to the following:

  • Network and connection information, such as the Internet Protocol (IP) address used to connect a computer (or other device) to the Internet and information about Customers' Internet service provider
  • Computer and device information, such as device, application, or browser type and version, operational system
  • Location of Customers' device or computer
  • Content interaction information, such as downloaded content, streams, and playback details
  • The content Customers viewed or searched for, website and app response times, and page interaction information
  • The information Cookies.
  • Other information as prescribed by the Policy and the law (if any)

6.3 Information we collect from other sources

6.3.1 We may collect Customer information from other sources, including partners and publicly available sources, including but not limited to:

  • Marketing, sales generation and employment information, including name, email address, physical address, phone number and other similar contact information
  • Information about registration, purchase, support or other information about Customers' interactions with our products, services or with third party products in connection with our Sites
  • Search results and links, including paid listings of products and services (like sponsored links)
  • Other information as prescribed by the Policy and the law (if any)

7. COOKIES COLLECTION AND USAGE

7.1 We use Cookies, Pixel and other similar technologies (collectively, “Cookies”) to identify Customer's browser or devices, learn more about Customers' preferences, provide Customers with essential features and services and for other additional purposes, including:

  • Identify whenever Customers use Our Sites: This allows us to provide Customers with recommendations, display personalized content, and provide other customized features and services
  • Be mindful of the preferences that Customers have agreed to. This allows us to respect the things that Customers like and dislike, such as the language and configuration that Customers choose
  • Conduct research and analysis to improve Our Sites
  • Prevent fraud
  • Improve security
  • Provide content, including advertising, relevant to Customers' interests on our and third-party websites
  • Measure and analyze the quality of Our Sites

8. HOW WE USE CUSTOMER INFORMATION

8.1 We use Customers data to operate, provide and improve Our Sites, including:

  • Measure, support and improve Our Sites: We use Customers' personal information to measure usage, analyze performance, correct errors, provide support, improve and develop Our Websites
  • Communicate with Customers: We use Customers' personal information to communicate with Customers regarding matters related to Our Websites through various communication channels (Email, Chat, SMS), Voice call…) and to answer Customers' requests.
  • Conduct Marketing: We use Customers' personal information to market and promote Our Sites as required by law. We may display advertisements for Our Sites based on information that Customers provide to us
  • Develop Cooperation: We use and/or partner with other companies and individuals to perform certain works and programs to support and enhance the Customer experience
  • Store: We retain Customers' personal data for as long as necessary to provide Customers with information about its legitimate and essential business communications, services and purposes of GEEK Up
  • Delete: We will proceed to delete Customers' data in the system at Customers' request, unless we are required to keep something or we still need to use it for a primary reason about legally valid, or to avoid re-collection of the data in the future

9. HOW WE SHARE CUSTOMER INFORMATION

9.1 As a general rule, we do not share Customers' information with anyone other than GEEK Up. However, we may share Customers' personal information with trusted third parties, including:

  • Advertising and marketing agencies to help us implement and analyze the effectiveness of advertising and promotion strategies
  • Third parties are required to deliver products or services to Customers, such as delivery or postal service of products that they have ordered
  • Competent state agencies that require us to disclose information
  • Third parties would like to send Customers information about their products and services, but only if Customers have given us their consent to do so
  • Third-party service providers for GEEK Up, for example LinkedIn, Facebook…

9.2 We may share Customers' personal information to:

  • Enforce applicable terms of usage of Our Websites
  • Conduct investigations for possible violations of applicable law
  • Detect, prevent, and protect against counterfeiting and security or technical vulnerabilities
  • Comply with applicable laws and regulations, cooperate in any legal investigation and respond to requests from competent state authorities
  • Other information as prescribed by the Policy and the law (if any)

9.3 We may also share Customers' personal information with companies, organizations or individuals outside of GEEK Up if we think disclosure of this information is necessary for lawful reasons.

9.4 Where we share Customers' personal information with a third party, we will use our best efforts to ensure that they will keep Customers' information confidential, taking all appropriate measures to protect against information misuse and use information only in a manner consistent with this Policy and applicable data protection laws and regulations.

10. CUSTOMERS' RIGHTS TO CONTROL INFORMATION

10.1 The Customers' information control rights are as follows:

  • Access: Customers are informed of the personal data we process about Customers and request access to that data
  • Correct: Customers may ask us to amend or update their personal data when it is inaccurate or incomplete
  • Erase: Customers can ask us to delete some of their personal data
  • Restrict access: Customers can ask us to temporarily or permanently stop processing all or some of their personal data
  • Counter: Customers may object to our processing of Customers' personal data at any time when there are grounds to determine that the collection and usage of our information is not in accordance with the provisions of this Policy and in accordance with the law
  • Data Migration: Customers have the right to request a copy of Customers' personal data in electronic format and the right to transfer such personal data for use in another parties' services
  • Other information as prescribed by the Policy and the law (if any)

11. CUSTOMER INFORMATION DATA STORAGE LOCATION

11.1 GEEK Up has its head office and office in Vietnam. Depending on the extent of Customers' interactions with Our Sites, Customers' personal information may be stored in or accessed not only in Vietnam but also from many countries. When we transfer their personal information to other countries, we will ensure that it is transferred in accordance with this Policy and applicable data protection laws and regulations.

11.2 Customers acknowledge that the storage of their information abroad will be governed by the laws of that country. At that time, the competent state authorities in the country in which their information is being kept may access this information in accordance with their laws. In accordance with this legal access request, anyone processing Customers' personal information outside of Vietnam is required to apply information protection measures and is only allowed to process the information in accordance with the instructions of GEEK Up.

12. HOW WE SECURE CUSTOMER INFORMATION

12.1 At GEEK Up, information security is our highest priority. Our system is designed with the ability to ensure the security and privacy of Customers' information. We commit to protect their personal data with appropriate technical measures in accordance with regulations.

12.2 When collecting data, we keep and secure personal information at the server system and this personal information is secured by firewalls, access control measures, and data encryption. We implement a variety of appropriate technical and security measurements, including access and storage encryption to prevent unauthorized access to personal information and unnecessary storage of personal data in our system.

12.3 GEEK Up does not take any responsibility in the event of a leak or loss of Customers' personal information if the leak or loss of this information is determined to be due to an intentional or unintentional error from Customers' side.

13. TERM OF STORING CUSTOMER INFORMATION

13.1 We store Customers' information to ensure their continued ability to use Our Sites, and store it for as long as necessary to accomplish the objectives set forth in this Policy. The length of time we retain specific personal information varies depending on the purpose of use, and we will delete Customers' information at their request or as required by applicable law.

14. UPDATE PRIVACY CHANGES

14.1 Our business is constantly changing and this Policy may also be revised. In the event of a change in the way we handle Customers' personal data or use Cookies, we will update our privacy policy and publish such change on this website. Customers are advised to visit and check our website regularly for the most recent changes.

14.2 Unless otherwise stated, our current Privacy and Security Policy is applied to all personal information we hold about Customers. Amending this Policy in no event will reduce the level of protection of personal information collected in the past without notice to Customers and relevant parties.
